~ AOTM Membership Referendum Act of 2023 ~
~ Preamble/Definition and Long Title of the AOTM Membership Referendum Act of 2023 ~
An Act of Tepoelan to make provision for establishing a referendum on a new question of the continuation of Salanda’s membership in the Alliance of the Micronations (AOTM).
~ Section One - Referendum Explanation ~
[Clause One] - A referendum shall be held to establish an answer on continuing Salanda’s membership in the Alliance of the Micronations (AOTM).
~ Section Two - Referendum Question and Options ~
[Clause One] - The Referendum question shall be as follows: ‘Do you wish for Salanda to stay as a member of the Alliance of the Micronations (AOTM) or leave as a member from the Alliance of the Micronations (AOTM)?’
[Clause Two] The options shall be as follows with no abstaining option since the referendum shall be voluntary participation under this Act of Tepoelan: ‘Salanda should remain’ I.e, Salanda should stay as a Member of the Alliance of the Micronations (AOTM) or ‘Salanda should leave’ I.e, Salanda will withdraw as a Member from the Alliance of the Micronations (AOTM).
~ Section Three - Status of the Referendum ~
[Clause One] - The Referendum shall be non-binding mean that the Government of Salanda does not have to act on it, though as the means of the democratic voice of the people it is recommended to follow through on what the result is but the Government of Salanda is not bound by the referendum results.
[Clause Two] - The winning option will be the option with the most percentages of voters, I.e, the winning option has to be over 50%, however as stated in Clause One, Section Three of this Act of Tepoelan the referendum is not binding in that the Government of Salanda will not be required or bound to follow through with the results of the referendum.
~ Section Four - Holding of the Referendum ~
[Clause One] - The Referendum shall run from Monday 22nd of January 2024 from 12am GMT till Friday 26th of January 2024 at 3pm GMT.
~ Section Five - Should the Government of Salanda follow through on the result if staying in the Alliance of the Micronations (AOTM) is won ~
[Clause One] - As stated in Clause One, Section Three of this Act of Tepoelan as this referendum is non-binding on the Government of Salanda, the Government of Salanda will not need to take any action on implementing on continuing Salanda’s membership in the Alliance of the Micronations (AOTM).
~ Section Six - Should the Government of Salanda follow through on the result if leaving the Alliance of the Micronations (AOTM) is won ~
[Clause One] - As stated in Clause One, Section Three of this Act of Tepoelan as this referendum is non-binding on the Government of Salanda it cannot also be the means to withdrawing from the Alliance of the Micronations (AOTM) in order to formally withdraw from the Alliance of the Micronations (AOTM), the Government of Salanda will have to pass a new Act of Tepoelan formally withdrawing Salanda from the Alliance of the Micronations (AOTM).
~ Section Seven - Entry of this Act of Tepoelan into Law of Salanda ~
[Clause One] - This Act of Tepoelan shall become effective as a law of Salanda upon the signing of this Act of Tepoelan after being passed by the Chamber of Provincial Emissary of the Tepoelan and as such this Act of Tepoelan shall become enforceable as a law of Salanda upon the Royal Seal of Salanda being placed upon this Act of Tepoelan.
~ Section Eight - Status of this Act of Tepoelan as part of the Law of Salanda ~
[Clause One] - This Act of Tepoelan cannot be repealed or amended by an Executive Order of Salanda and as such can only be repealed or amended by another Act of Tepoelan or by an Amendment to the Constitution of Salanda also known as the Basic Foundation Laws (of Salanda).
