                 ~ Background of Property Been Damaged Act of 2023 ~


After numerous damages to State Property/Public property and Private Property in Salanda since Salandarian Independence leading up to this day when it was decided to make this Act of Tepoelan, the Government of Salanda has decided that something needs to be done to combat this and shall outline the principles of this Act of Tepoelan below.


                 ~ Definition of Property Been Damaged Act of 2023 (Long Title) ~


This Act of Tepoelan of which the definition shall also become law of Salanda, by resolution of the Chamber of Provincial Emissary is to be defined as setting up a framework for what happens when State Property/Public Property which is property that is owned by the State which includes the damage of the two divisions of property which are physical property for example; public sports property and nonphysical property for example; online institutions of Salanda and Private Property which is defined as the property of People in Salanda whether they have Citizenship of Salanda or not with similar examples to State Property/Public Property that has been damaged by man-made causes and does not apply when natural causes or other non-man made causes which the state shall cover for in those situations, this Act of Tepoelan shall lay out the sections when State Property/Public Property of Salanda and Private Property is harmed or may be harmed by man-made causes and shall lay out the principles and consequences in the following sections. The State shall only impose on below the sections of this Act of Tepoelan on the said breakers of State Property/Public Property or Private Property with due and fair evidence providing proof that it is those said breakers that this Act of Tepoelan can be imposed on. The State shall also be able to make people sign a contract in front or not in front of witnesses depending on the matter to ensure they are held accountable when in contact with State Property/Public Property and Private Property of People in Salanda.


                           ~ Section One - State Property/Public Property Damage ~


This Act of Tepoelan makes clear that the use of State Property/Public Property is a privilege not a right and can be taken away from individuals should they break this Act of Tepoelan’s contents. 


If State Property/Public Property whether physical or nonphysical (with examples of both divisions of physical and nonphysical property stated above in the Definition of the Property Been Damaged Act of 2023) is damaged the State shall suspend and ban including permanent banning (with suspensions and bans including permanent bans being decided by the State which can be on bans from state property and being banned from Salanda as a whole) people from using State Property/Public Property depending on how it views the severity of the crime committed, the State can also fine up to double the cost of the cost of the State Property/Public Property that has been damaged to people. If the State views the damage as severe it can detain the said persons for five days and can suspend or revoke their Salandarian Citizenship, if they have no Salandarian Citizenship the State can still detain them through a Salanda Police Force, shall the State have the ability to issue out prison sentences (the State can also issue home arrests shall it be able to) for the damage of State Property/Public Property, the sentence of damage to State Property/Public Property shall be set out by the Courts of Salanda (i.e, the Salandarian Justice System). If said person or persons cannot pay fines set out by the State, they shall be given a fair trial and fair, appropriate reasonable and realistic ruling by the Courts of Salanda (i.e, the Salanda Justice System) who shall find an appropriate and fair ruling to punish them for breaking State Property/Public Property.


  ~ Section Two - Restricting use of State Property/Public Property on Offenders and Suspected Offenders with intention or not of this Act of Tepoelan ~


Offenders of this Act of Tepoelan shall not be able to use State Property/Public Property for however long the State desires (i.e, the Government of Salanda). For violators of this Act of Tepoelan as stated above the State (i.e, the Government of Salanda) can place offenders of this Act of Tepoelan under house arrest if possible or just outright denying them if it is non physical property of the State (i.e, the Government of Salanda).


        ~ Section Three - Helping Said Offenders (State Property/Public Property) ~ 


If People help said Offenders of this Act of Tepoelan access State Property/Public Property, they shall also be considered Offenders of this Act of Tepoelan and shall be given the same treatment to Offenders of this Act of Tepoelan which as such is mentioned in Section One of this Act of Tepoelan regarding State Property/Public Property.


                   ~ Section Four - Stealing State Property/Public Property ~


If People steal State Property/Public Property they shall be treated as Offenders of this Act of Tepoelan and shall pay for what they stole or return it (physical and non physical property) to the State (i.e, the Government of Salanda) or be placed on bail and be treated with the punishments part of Section One of this Act of Tepoelan regarding State Property/Public Property.


           ~ Section Five - Accidental Damage to State Property/Public Property ~


The response to accidental damage to State Property/Public Property as mentioned including physical and nonphysical State Property/Public Property shall be defined by the State as how severe this Accidental Damage to State Property/Public Property, the State shall list the person or persons who caused this accidental damage on a register that shall be monitored by the State and shall be able to fine the person or persons the cost of how much the State Property/Public Property costs, if they cannot pay a said fine, they shall be given a fair trial and fair ruling by the Salanda Courts System (i.e, the Salandarian Justice System) who shall find a fair, reasonable and realistic ruling to hand down to them for accidentally breaking State Property/Public Property. Shall they repeat the same accident by breaking State Property/Public Property again accidentally the Salanda Courts System (i.e, the Salandarian Justice System) shall give a fair trial and a fair ruling shall be handed down to them by the Salanda Courts System (i.e, the Salandarian Justice System) which shall make the fair ruling appropriate but reasonable and realistic to what State Property/Public Property they broke and their background of accidental damage to State Property/Public Property.


                             ~ Section Six - Private Property Damage ~


If Private Property of [a] Person/s in Salanda is/are damaged physical property or non physical property, the owner of the Private Property should contact a Salanda Police Force who shall examine and investigate to try and find the Perpetrator or Perpetrators if no perpetrator or perpetrators are found, security shall be tightened around the damage if it is physical or if non physical it shall be tried to be made as secure as possible by a Salanda Police Force for up to two weeks, if a perpetrator or perpetrator is/are found they shall be charged and subject to a fair trial with due and fair evidence by the Courts of Salanda (i.e, the Salandarian Justice System) of which the punishments can be fines, restrictions imposed on the perpetrator or perpetrators or suspension banishment from Salanda meaning Citizenship of Salanda is revoked permanently with no ability to regain it like Section One of this Act of Tepoelan (which can include a permanent banishment from Salanda) these punishments shall be handed down by the Courts of Salanda (i.e, the Salandarian Justice System) depending on the severity of the crime committed with private property, intellectual property damage or theft is included in this section of this Act of Tepoelan.       

 ~ Section Seven - Restrictions and consequences imposed on Offenders and Suspected Offenders with intention or not of this Act of Tepoelan (Private Property)  ~


Offenders or Suspected Offenders of Section Six of this Act of Tepoelan shall be placed if needed by the State under house arrest if physical or if nonphysical they shall be removed by the State if needed from areas anywhere near Private Property of People in Salanda with both of these cases applying up to two weeks until they shall be given a fair trial with due and fair evidence by the Courts of Salanda (i.e, the Salandarian Justice System).

                 ~ Section Eight - Helping Said Offenders (Private Property) ~


If People help said Offenders of this Act of Tepoelan access Private Property of People in Salanda they shall also be considered Offenders of this Act of Tepoelan and shall be given the same treatment as Offenders of this Act of Tepoelan which as such is mentioned in Section Six of this Act of Tepoelan regarding Private Property of People in Salanda.

                   ~ Section Ten - Accidental Damage to Private Property ~


The response to accidental damage to Private Property of People in Salanda as mentioned including physical and nonphysical Private Property of People in Salanda shall be defined by the State as how severe this Accidental Damage to Private Property of People in Salanda, the State shall list the person or persons who caused this accidental damage on a register that shall be monitored by the State and shall be able to fine the person or persons the cost of how much the Private Property of People in Salanda costs, if they cannot pay a said fine, they shall be given a fair trial and fair ruling by the Salanda Courts System (i.e, the Salandarian Justice System) who shall find a fair, reasonable and realistic ruling to hand down to them for accidentally breaking Private Property of People in Salanda. Shall they repeat the same accident by breaking Private Property of People in Salanda again accidentally the Salanda Courts System (i.e, the Salandarian Justice System) shall give a fair trial and a fair ruling shall be handed down to them by the Salanda Courts System (i.e, the Salandarian Justice System) which shall make the fair ruling appropriate but reasonable and realistic to what Private Property of People in Salanda they broke and their background of accidental damage to Private Property of People in Salanda.


                  ~ Section Eleven - Enforcement of this Act of Tepoelan ~


Whereby it is declared that the Tepoelan can help the enforcement of this Act of Tepoelan by legislating more appropriate legislation related to this Act of Tepoelan. The State shall be held to account if it has or hasn’t enforced this Act of Tepoelan in full properly.

          ~ Section Twelve  - Entry of this Act of Tepoelan into Law of Salanda ~

This Act of Tepoelan shall become effective as a law of Salanda upon the signing of this Act of Tepoelan after being passed by the Chamber of Provincial Emissary of the Tepoelan and as such this Act of Tepoelan shall become enforceable as a law of Salanda upon the Royal Seal of Salanda being placed upon this Act of Tepoelan.

~ Section Thirteen - Status of this Act of Tepoelan when in force as a Law of Salanda ~

This Act of Tepoelan cannot be repealed or amended by an Executive Order of Salanda and as such can only be repealed or amended by another Act of Tepoelan or by an Amendment to the Constitution of Salanda also known as the Basic Foundation Laws (of Salanda).
